Determining Whether You Are Eligible

To apply for U.S. citizenship, you must meet the following requirements:

  • You must be a permanent resident (have a green card).
  • You must have lived in the U.S. for five years (three years if you are married to a U.S. citizen) and not have been out of the U.S. for 30 months or more, or taken a trip outside the U.S. that lasted one year or more.
  • You must have lived in the state where you are applying for citizenship for at least three months.
  • You must take and pass an exam testing your ability to read and write English, and your knowledge of U.S. history and government.
  • You must be of good moral character, meaning you have not committed any crimes in the U.S.
There are exceptions to these requirements. If you fail to meet one of the above, you still may be eligible for U.S. citizenship. An experienced immigration lawyer will be able to advise you of your options.

Some barriers are harder to overcome than others. For example, if you were convicted of a minor crime or have outstanding unpaid child support, becoming a U.S. citizen will be difficult. If you entered the U.S. illegally, you will need to become a permanent resident first.
