In filing an application, we may seek a cancellation of removal if have been a legal permanent resident for at least five years and:
- Were legally admitted to the United States
- Have lived in the U.S. continuously for at least seven years (that is, you did not leave for a period of time and then reenter the U.S.)
- Have not been convicted of a felony; or
- If convicted of a crime, you can receive waivers
Cancellation of removal for those here on a non-immigrant visa (no "green card") may be granted if:
- You have a qualifying relative in the U.S.
- Have lived in the U.S. continuously for at least 10 years (did not leave the for a period of time and then reenter the U.S.)
- Have demonstrated "good moral character"
- Can prove that deportation would create a hardship for your spouse, parents or children
