You may be eligible for relief from removal if:

  • You fear political, religious, ethnic or other forms of persecution and are seeking asylum
  • You have no criminal charges against you and can prove hardship to a qualifying U.S. citizen relative
  • You have family in the United States
  • Are a victim of domestic violence (Violence Against Women Act, also known as VAWA)

In filing an application, we may seek a cancellation of removal if have been a legal permanent resident for at least five years and:

  • Were legally admitted to the United States
  • Have lived in the U.S. continuously for at least seven years (that is, you did not leave for a period of time and then reenter the U.S.)
  • Have not been convicted of a felony; or
  • If convicted of a crime, you can receive waivers

Cancellation of removal for those here on a non-immigrant visa (no "green card") may be granted if:

  • You have a qualifying relative in the U.S.
  • Have lived in the U.S. continuously for at least 10 years (did not leave the for a period of time and then reenter the U.S.)
  • Have demonstrated "good moral character"
  • Can prove that deportation would create a hardship for your spouse, parents or children
